This case resulted in a Supreme Court reversal of lower court trial and appellate decisions holding that the Commission had complied with the law in issuing permits to a corporation to build and run a hazardous waste disposal plant.
Our firm also represented the class action plaintiffs in McCastle v. Rollins, one of the earliest environmental justice cases in the United States. Residents of East Baton Rouge Parish complained of a nearby hazardous waste disposal facility that was disposing of a chemical sludge material through a process colloquially called land farming. This operation produced harmful chemical fumes which caused pain and discomfort and led to an increased risk of cancer and other diseases. Although the lower courts failed to certify the case as a class action, we took the issue to the Supreme Court, which agreed with our position and ordered the certification, allowing the case to proceed as a class action. This decision has been cited over 100 times in other court cases ruling on class action certification.
